COPYRIGHT REGISTRATION
- WHAT IS COPYRIGHT ?
- It is a kind of intellectual property protection like trademark and patents.
- Copyright registration is done following the Copyright Act, 1957.
- With copyright registration, you become a legal owner of your creative work in respect of books, paintings, music, website, etc.

DOCUMENTS REQUIRED FOR COPYRIGHT REGISTRATION
- Name, Address & Nationality of the Candidate – ID proof
- NOC from the publisher if work published and publisher is different from the applicant.
- Search Certificate from Trade Mark Office (TM -60) if any
- NOC from a person whose photograph appears on the work.
- Power of Attorney
- 2 Copies of work
- KYC of author
- DD/IPO of Rs. per work (as applicable)
- NOC from the author if the candidate is different from the author.
PROCEDURE FOR COPYRIGHT REGISTRATION
DETAILS AND DOCUMENT COLLECTION
- Based on the type of work, we will pick the right Copyright Application from you.
- We will collect from you, all the necessary information and documents that will be required for the process.
- The Authorization Letter will be sent to you to get it signed from you.
FILING THE COPYRIGHT APPLICATION
- Once all the details have been collected and verified by us.
- Our Experts will prepare the Copyright Application and submit the necessary Forms with the Registrar electronically.
DAIRY NUMBER AND COPYRIGHT EXAMINATION
- You will get a Diary Number once the Application is submitted.
- Using this, you can Track your Application.
- There is a waiting period of 30 days within which the Copyright Examiner reviews the Application for potential Discrepancies and/or Objections.
- If there is a Discrepancy, a Notice will be issued and the same needs to be responded to within 30 days from the date of Issuance of the Notice.
COPYRIGHT REGISTRATION
- Once the Discrepancy has been removed or there are no discrepancies or objections with the Application, the Copyright shall be Registered.
- The Copyright Office shall issue the Extracts from the Register of Copyrights (ROC)/Registration Certificate.
- Registration of Copyright might take up to 12 months from the Date of Issuance of the Diary Number.

- If there are some clarifications and/or some defects in the Application on your account that have to be addressed, we will do it for you at an Additional Cost.
- In case of an objection to your Application, from interested parties, or the Examiner, you would need to file a response within 45 days.

Can Titles or Names be copyrighted?
No. The partners of a firm are actual owners and have unlimited liability. There is no separation of identity between the partners and the firm of partnership.
What is the difference between Copyright Registration and Trademark Registration?
- Trademark registration protects the brand name, logo the slogan.
- Copyright protection is provided to literary works, music, videos, slogans, and artistic contents.
How long is the Copyright Registration valid?
- Copyright registration has a validity of 60 years. • The computation of the number of years starts from the death of the author in case of literary, drama, music works.
- But in the case of the films, sound recording, photographs the 60 Year validity period is considered from the date of publication
Copyright obtained in India is only valid in India or across the World?
According to the Berne Convention, copyright obtained in India will get the status of foreign workers and the copyright protection is extended to the countries which are signatories to the Berne Convention.
Is it possible to sell or transfer Copyright Registration?
With the consent from the owner of the work, the copyright registration can be sold, transferred, gifted as well as franchised.
What are the benefits of Copyright Registration?
The holder can translate, reproduce, adapt, create the work, and also to the right to be credited for his contribution, a right for who can adapt the work to other forms.
Is it necessary to publish the work before Copyrighting it?
No, it is not necessary to publish the work before copyrighting it. Both Published as well as unpublished work can be registered. • In case work is already published the details of the publishing are to be furnished with the application.
Is the Copyright Registration application get rejected?
Yes, in case of any discrepancy or incomplete documents a copyright registration may get rejected.
Who can obtain Copyright Registration?
- Any person or a business entity can obtain copyright registration.
- An individual can be an author, creator, musician, photographer, producer, painter, composer, or company.
What to do in case of infringement of Copyright?
A copyright holder has to send a statutory notice to the person who has infringed the work.
What is the remedy available if someone has charged Copyright infringement against me?
After receiving the notice intimating charge of infringing the copyright, you may seek legal assistance and either conduct an out of court settlement or approach the district court with jurisdiction.
